Digital Millennium Copyright Act Policy
Welcome to https://educemy.com/ (the “Site”). We have the same respect for the intellectual property rights of others as we would expect others to have for ours. A copyright owner or their agent may submit a takedown notice to us through our DMCA Agent set forth below, under the provisions of the Digital Millennium Copyright Act, Title 17, United States Code, Section 512(c).
As an internet service provider, we have the right to immunity from those infringement claims under the “safe harbor” provisions of the DMCA. To make a good faith infringement claim against us, you are required to provide notice to us providing the following information:
Notice of Infringement - Claim
A physical or electronic signature of a person authorised to act on behalf of the owner of the copyright;
Identification of the copyrighted work alleged to have been infringed;
A description of the infringing material to be dealt with and information reasonably sufficient to enable the service provider to locate the material. [Please include as many identifying details as you can, including the URL of the page in question, to help us identify the work you deem infringing];
Information reasonably sufficient to enable the service provider to contact the complaining party, including your name, physical address, email address, telephone number and fax number;
A statement that the complaining party has a good-faith belief that the use of the material by the copyright agent is authorised and a statement that the information in the notification is accurate, and, under penalty of perjury, that the complaining party is authorised to act on behalf of the copyright owner;
17 USC §512(f) provides that any person who, in a notification of infringement made under 17 USC §512(c)(3), materially misrepresents under the provisions of this section that material is infringing, or that activity is infringing, shall be liable for any damages, including costs and attorney fees, incurred by the alleged infringer or by a service provider, which results from the misrepresentation by such person.
All takedown notices should be sent via our Contact page. Please email for immediate attention.
We may disclose the identity and information in any such copyright infringement claim to the alleged infringer. When you submit a claim, you acknowledge and agree that your identity and claim may be disclosed to the accused infringer.
Counter Notification — Restoration of Material
Suppose we have informed you that we have taken down material in response to a copyright infringement claim. In that case, you may submit a counter-notification to us seeking restoration of the material in question for the site.
An effective notification should be submitted in writing to our DMCA Agent and should include, at minimum, the following information pursuant to 17 USC Section 512(g)(3):
Your physical or electronic signature;
A description of the content that has been removed and where the material was initially located before being removed.
A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled.
Include your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or if your address is outside of the United States, that you consent to the jurisdiction of any judicial district in which the service provider may be found), and that you will accept service of process from the person or company who provided the original infringement notification.
Please send a counter notice via our Contact page. Email is highly recommended.
Repeat Infringer Policy
Copyright infringement is not a joke, and we take it very seriously. In accordance with the DMCA’s requirements regarding repeat infringer policies, we keep a list of copyright holders who have submitted DMCA notices and make a good-faith effort to identify and terminate repeat infringers.
Accounts that violate our internal repeat infringer policy will be terminated.
Modifications
We may change the content of this page and the DMCA Claims Policy at any time for any reason.
